Use of Active Communications Services means acceptance of the following user policy.

The activecom.net Acceptable Usage Policy (AUP) has the following goals:

  • Ensure security, reliability and privacy of activecom.net's systems and network, and the networks and systems of others.
  • Preserve the privacy and security of both our client organizations and their individual users.
  • Encourage the responsible use of net resources, discouraging practices which degrade the usability of network resources and thus the value of Internet services.
  • Maintain the image and reputation of activecom.net as a responsible provider.
  • Preserve the value of Internet resources as a conduit for open and free expression.
  • Avoid situations that may cause activecom.net to incur civil liability.
  • We hope not to impose suspension or cancellation of any accounts but we feel everyone should be committed to making the Internet as friendly and fair as possible.

This statement represents guidelines for the acceptable use of the activecom.net Services for data communications. It is intended to be applicable only to the use of activecom.net's networks.

In such instances where data communications leave activecom.net's network and are carried by other networks or the Internet, the acceptable use policies of other networks are applicable, and must be respected.

Applicability

The Acceptable Use Policy defines the actions which activecom.net considers to be abusive, and thus, strictly prohibited. The examples named in this list are non-exclusive, and are provided solely for guidance to activecom.net customers. If you are unsure whether any contemplated use or action is permitted, please send mail to abuse@activecom.net and we will assist you.

Please note that the actions listed below are also not permitted from other Internet Service Providers on behalf of, or to advertise, any service hosted by activecom.net, or connected via the activecom.net network.

Furthermore, such services may not be advertised via deceptive marketing policies, as defined by the Federal Trade Commission Deception Policy Statement.

Tenets of Appropriate Usage

  1. To respect the privacy of the users of activecom.net services, and all networks accessible via activecom.net services.
  2. To respect the legal protection provided by copyright, license, and other applicable legal devices to programs, communications, and data.
  3. To respect the integrity of computing systems, and to not use activecom.net Services to compromise same.
  4. To respect common usage of Network News and E-mail services.

Specifically Acceptable Uses

  1. Usage for private, personal, or business communications which do not infringe upon the rights of any other individual.
  2. Usage for public communications as suggested by the charters of USENET newsgroups, and the well known guidelines generally accepted by the users and news administrators of same.
  3. Usage for data communications in accordance with applicable laws.

Violation of Policy

activecom.net will review alleged violations of Acceptable Usage Policy on a case by-case basis. Violations of policy may result in immediate termination of activecom.net services.

Usage of activecom.net's network constitutes an agreement to abide by these guidelines.

activecom.net will apply the following charges to unsolicited commercial e-mail, or misposted Network News articles (spamming).

Violation Charge per Instance
Unsolicited Commercial E-mail: $500 - $2000
Misposted Network News Articles: $500 - $1000
Malformed Mail Headers: $200 - $500

General Conduct

  1. Customers are prohibited from transmitting on or through any of activecom.net's services, any material that is, in activecom.net's sole discretion, unlawful, threatening, abusive, libelous, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law.
    (activecom.net does not intend to monitor the information transfers for obscene or otherwise objectionable behavior, however the clients of activecom.net must behave in accordance with US laws.)
  2. activecom.net services may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute. activecom.net reserves the right to remove such illegal material from its servers.
  3. The customer is responsible for keeping his billing data with activecom.net up-to-date and accurate. Furnishing false data on the sign-up form, contract, or online application, including fraudulent use of credit card numbers, is grounds for immediate termination, and may subject the offender to civil or criminal liability.
  4. The resale of activecom.net products and services is not permitted, unless specifically permitted and documented in a written agreement.
System and Network Security
  1. Customers may not attempt to circumvent user authentication or security of any host, network, or account (cracking). This includes, but is not limited to:
    • accessing data not intended for the Customer
    • logging into a server or account the Customer is not expressly authorized to use
    • probing the security of other networks
  2. Customers may not attempt to interfere with service to any user, host, or network (denial of service attacks). This includes, but is not limited to:
    • flooding of networks
    • deliberate attempts to overload a service
    • attempts to "crash" a host
  3. Password security is the responsibility of the individual and organization in control of that account. Good passwords should be a minimum of six characters long, contain at least one number or symbol, and are not based on any dictionary word or common name.
  4. Under no circumstances should customers share passwords with people not directly responsible for managing the service for which a password has been supplied.
  5. Customers may not use any kind of program, script, command, or send messages of any kind, designed to interfere with a user's service via any means, within activecom.net Services, or by the Internet.
  6. activecom.net Services often depend on shared resources, including, but not limited to, CPU time, memory, disk space, and network bandwidth.

    The use of resource-intensive programs which negatively impact other system users or the performance of activecom.net systems or networks is prohibited. The use of these programs will be deemed to be a denial-of-service attack, and activecom.net staff may take action to limit or terminate such programs, in addition to any necessary legal action.

  7. Customers are prohibited from engaging in activities which harass other users. This includes, but is not limited to:
    Term Definition
    spam attempting to send private messages to those who do not wish to see them
    takeovers forcibly seizing operator privileges
    flooding rapidly entering text with the intent to fill the screens of others
    flashing disrupting terminal emulation
    more.. any other abusive or disruptive behavior.
  8. Users who violate systems or network security may incur criminal or civil liability. activecom.net will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.

Electronic Mail

All statements concerning e-mail also apply to Network News.

  1. Harassment, whether through language, frequency, or size of messages, is prohibited.
  2. Customers may not send e-mail to any person who does not wish to receive it. If a recipient asks to stop receiving e-mail, the customer must not send that person any further e-mail.
  3. Customers are explicitly prohibited from sending unsolicited bulk mail messages (junk mail or spam). This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, and political tracts. Such material may only be sent to those who have explicitly requested it.
  4. Customers may not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such mailings.
  5. Malicious e-mail, including but not limited to "mailbombing" (flooding a user or site with very large or numerous pieces of e-mail), is prohibited.
  6. Forging of e-mail header (envelope) information is prohibited.
  7. Activecom.net accounts or services may not be used to collect replies to messages sent from another Internet Service Provider, where those messages violate this Acceptable Use Policy or the Acceptable Use Policy of that other provider.
  8. These rules apply to any other types of Internet-based distribution medium where messages from be exchanged between users.

Network News

All of the considerations which apply to E-mail apply also to Network News, in addition to the following:

  1. activecom.net provides an uncensored newsfeed. As such, activecom.net does not control the content of the public newsgroups available to its customers. activecom.net is not responsible for the content of any Network News posting, whether or not the posting was made by a activecom.net customer.
  2. Postings to Network News newsgroups must comply with the written charters or FAQs for those newsgroups. Advertisements should only be posted in those newsgroups whose charters/FAQs explicitly permit them. The poster is responsible for determining the etiquette of a given newsgroup, prior to posting to it.
  3. Customers are prohibited from posting the same or similar message to large numbers of newsgroups (excessive cross-posting or multiple-posting, also known as spam).
  4. Customers are prohibited from posting binary files to newsgroups not specifically named for that purpose.
  5. Customers are prohibited from canceling or superseding posts other than their own, with the exception of official newsgroup moderators performing their duties.
  6. Customers are prohibited from forging header information. This includes attempting to circumvent the approval process for posting to a moderated newsgroup.
